Homeless Man Cleared of Murder

READING, PA - Murder charges against a homeless man were dismissed after a Berks County judge ruled that a fingerprint found on a cigarette carton was not proof of the man's guilt.
Judge Thomas Eshelman dismissed second-degree murder and assault charges against 35-year-old Eduardo Padilla, and Padilla was released from the Berks County Prison on Friday.

Eighty-one-year-old Peter Morrell of Wyomissing died ten days after he was assaulted and robbed June 27th, 2000, at his Liberty Hat Cleaning Shop in Reading.

Police found Padilla's fingerprint on a cigarette carton dropped by the robber. Five other fingerprints on the carton were not identified.

Police said Padilla admitted stealing cigarettes from Morrell's shop but denied touching Morrell.
